CHARLESTON, W.Va. (AP) — The Hatfield McCoy Recreation Authority isn’t following state purchasing, ethics and employee bonus laws, according to the state legislative auditor.
In a letter Tuesday, Aaron Allred referred to $1.3 million in leases, insurance policies, labor, catering and other contracts that benefited other interests of the executive director, board members or their family.
The authority, which oversees more than 700 miles of all-terrain vehicle trails in WV West Virginia, is operating like some laws don’t apply to it, the letter states.
“The laws discussed in this letter are not mere bureaucratic hoops and tests,” Allred wrote. “They are important controls on the management of public money and they are designed to prevent abuse and waste.”
The letter says the authority should be complying with the competitive bid process, contract reviews by the attorney general and other purchasing requirements.
The auditor wrote that authority board members are subject to the state Ethics Act, which prohibits self-dealing and personal gain from public office.
The letter also adds that the authority’s employees or contractors can’t receive bonuses.
The Post Audit Division is still reviewing the authority’s financials.
Some contracts that the authority listed as “related party transactions” for 2011, 2012 and 2013 include:
— Liability insurance for about $386,300. A board member owns the insurance agency.
— $820,400 in labor. The executive director and another authority board member serve on the contractor’s board.
— Industrial storage building lease from the Wyoming County Economic Development Board for about $34,800. One authority board member is a development board employee. The executive director and another board member are development board members.
— Others include: almost $5,900 to a catering company owned by the executive director’s mother; $24,300 for vehicle maintenance through a company owned by a board member; $28,400 to a building maintenance company whose board includes the executive director; $23,300 in printing services from a company owned by the executive director’s dad; and $36,700 from the state Division of Tourism, for which the executive director serves as a board member.
The authority has long received state funding, including about $200,000 in state money annually since 2011. They also receive money through selling bonds and security interests and charging to use recreational facilities.
According to the auditor’s letter, the authority’s executive director did not deny that the laws applied, but questioned the circumstances that caused the inquiry.
The executive director said the authority will work to bring it into full compliance, the letter states.

| I hate to hear this report. Maybe it is not too late to tighten-up those that need it and replace those that need replacing.
Understanding that there are mixed feelings about the trails from some of the local folks and is certainly understood. BUT, The trail systems also offer many riders from out of state some of the best riding conditions for them, family, and friends they can find anywhere within reason.

| I and some members of ATVWV have been fairly active on the HM forum, and several of us have been banned from that forum. The executive, Lusk and Pinkerton, do not appear to run it as if the state owned it. You cannot mention any lodging establishment that does not pay them sponsor fees. Remember their purpose is to bring business to small communities. Threads that mention Mtn Top Cabins, Pinnacle Creek Campround, Riders Paradise, etc will be deleted. I for one think they need a thorough investigation and house cleaning. | |

| Would hate to see H&M take a hit. Without them, many businesses would disappear. However, I don't believe in exceptions to the law. If the authority is in the wrong, they need to be held accountable. | |

| I just don't see it closing or hindering HMT........as a "local".....we see the economic impact on the areas devastated by the decline and departure of the coal industry......surely the the county commissions see the same......I think either it will be cleaned up or they will be replaced......not just people like Pinnacle Creek campground or Riders Paradise.....But Towns like Welch, Gilbert and Pineville....have a significant investment and a considerable amount at stake as far as these WV towns go, that were close to ghost towns just a few short years ago......now have at least a slight bit of economic hope......I think at this point it has gotten bigger than the people who created it, and if they continue to push it they will find out for themselves..... | |
